Terms of Service
These terms describe how The Fabrica OS may be used. They are maintained by The Fabrica and are not legal advice to you. Last updated 6 August 2026.
Company information
The Fabrica OS is provided by Da Silva Miranda Edgar, trading as The Fabrica, with registered address at 68 Rue Dicks, 4082 Esch-sur-Alzette, Luxembourg, VAT number LU34978414, phone +352 671 547 442, email info@thefabrica.eu.
The service
The Fabrica provides product validation, sample development, pattern making, sourcing, cut & sew production, print, embroidery and finishing. The customer workspace supports technical files, quotations and production coordination. Existing software subscriptions are separate from manufacturing services.
Accounts
You are responsible for the accuracy of the information you submit and for keeping your credentials secure. One free item per module is available before a subscription is required.
Subscriptions and billing
Plans are billed monthly in advance through our payment provider and renew until cancelled. Starter is €39 for the first month and €49/month afterwards, Growth is €139 for the first month and €149/month afterwards, and Brand is €399/month. Introductory first-month prices apply to new subscriptions only. Plans include 8, 20 and unlimited tech packs per month respectively; fair-use limits reset each billing month and are not carried over. You can cancel at any time from Settings; access continues to the end of the paid period and part periods are not refunded except where required by law. Prices are shown in euros and include VAT.
Production invoices and payment
Production is quoted separately from your subscription. You receive a private invoice link showing the specification, quantities, shipping and taxes, and you can approve it or request changes. Approving an invoice creates a production order and is a commitment to the stated amount. Payment of production invoices is made by bank transfer under the payment terms printed on the invoice, normally a deposit on approval and the balance before shipping. Production starts once the deposit is received and the tech pack is approved.
Cancellations and changes to an order
Because items are made to your specification, orders cannot be cancelled once cutting has started, and deposits covering purchased fabric, trims and customisation are non-refundable. Changes requested after tech pack approval may affect price and lead time and must be confirmed in writing.
Account deletion and data
You can erase your content or delete your account at any time in Settings → Data & privacy. Deleting your account does not cancel an active subscription — cancel it in Manage billing first. Records we must retain for accounting are kept in anonymised form. See our Privacy Policy.
AI output, estimates and quotes
Specifications, complexity scores and costs generated by the platform are indicative. They are produced with AI assistance and can contain mistakes. Final pricing, MOQ, lead time and construction are confirmed by the atelier after review and sampling. Nothing on the platform is a binding offer until confirmed in an order.
Production orders
Orders enter production after tech pack approval. Minimum order quantities and lead times depend on the factory and fabric availability. Reasonable variation in colour, weight and measurements within industry tolerance is not a defect.
Intellectual property
You keep the rights to your designs, brand assets and uploads, and you grant us the licence needed to run the platform and to share files with the factory producing your order. You confirm you have the rights to what you upload. The platform, its software and its engines remain our property.
Acceptable use
Do not use the platform to infringe third-party rights, to produce counterfeit goods, to reverse engineer the service, or to attempt to access other users' data.
Liability
The platform is provided on an as-is basis. To the extent permitted by law, our liability is limited to the amounts you paid us in the twelve months before the claim. We are not liable for indirect or consequential loss, including lost sales from a delayed drop.
Suspension and termination
We may suspend or close an account that breaches these terms, fails to pay, or puts the platform or other users at risk. You can stop using the service at any time by cancelling your plan.
Governing law and changes
These terms are governed by the laws of Luxembourg, and the courts of Luxembourg have jurisdiction, without affecting consumer rights you may have in your country of residence. We may update these terms as the platform changes; material changes are communicated by email to account holders and apply from the next billing period.
